In a recent study, it was found that 83% of large employers use artificial intelligence for some type of employee decision-making and it can be found in almost all aspects of employment: from hiring to firing. In a lawsuit filed by the EEOC in 2022, the federal government accuses three English-language tutoring organizations of discriminating against older applicants by adjusting their AI systems to automatically filter out job seekers above a certain age. According to the EEOC, the groups rejected over 200 applicants due to their age, setting parameters to reject all women over 55 and all men over 60.

"Even if technology automates discrimination, the employer is still responsible," said EEOC Chair Charlotte Burrows in a press release about the lawsuit. "This case is an example of why the EEOC recently launched an initiative on artificial intelligence and algorithmic fairness. Discrimination by an employer through the use of technology can rely on the EEOC for relief."

Another lawsuit filed in February alleges that Workday, a popular HR platform that uses AI, rejected a job applicant based on his race, age, and disability, violating Title VII of the Civil Rights Act of 1964. In this case, plaintiff Derek Mobley accuses the authors of Workday's AI system of discriminating against Black people, individuals over 40, and people with mental disabilities such as depression and anxiety.

"These AI programs can really help companies lawfully achieve their workforce diversification goals," said Sonderling, appointed by former President Donald Trump, to the Washington Examiner. "However, if they use them to intentionally target individuals with certain protected characteristics such as age, race, gender, religion, or national origin, they cannot be used to intentionally select those individuals for jobs."
