Garante Sets Demands for OpenAI's ChatGPT to Resume in Italy Amid Privacy Concerns

Italy's data protection agency, known as Garante, has set out a list of demands for ChatGPT to meet before it can resume operations in the country. ChatGPT is a chatbot service created by OpenAI and backed by Microsoft, which has been taken offline in Italy following concerns over a potential breach of privacy rules.

In response to these concerns, Garante has requested that OpenAI addresses its demands, with the hope that ChatGPT will once again become accessible in Italy. The authority has laid out specific "concrete" demands that need to be met by the end of this month, with the assurance that it will suspend its provisional restrictions on the use of data of Italian users if these demands are met.

OpenAI has not yet commented on Garante's demands. However, the authority has asked OpenAI to inform users in Italy of the "methods and logic" behind the processing of data necessary for ChatGPT to operate. Additionally, OpenAI must provide tools to enable people whose data is involved to request the correction of any inaccuracies or the deletion of their data if a correction is not possible.

Moreover, OpenAI should introduce an age verification system by the end of September that can exclude access to users under 13. The watchdog has also requested that non-users should be able to oppose the processing of their personal data in a simple and accessible manner.

Garante will continue to investigate potential breaches of data protection rules by OpenAI, reserving the right to impose further measures if necessary. The move by Italy has raised concerns among privacy watchdogs across Europe, who are studying whether harsher measures are needed for chatbots and how to coordinate their efforts.

Spain's data protection agency has asked the European Union's privacy watchdog to evaluate privacy concerns surrounding ChatGPT. In February, the Italian regulator banned AI chatbot company Replika from using the personal data of users in Italy, citing risks to minors and emotionally fragile people.

The development of AI has attracted attention from lawmakers and regulators worldwide, with many experts calling for new regulations to govern AI due to its potential impact on national security, jobs, and education. The Italian move on ChatGPT highlights the need for strict regulations that protect users' data privacy while still allowing the development and innovation of AI technologies.
